1Acceptance of Terms & Electronic Contract

These Terms of Service ("Terms", "Agreement") constitute a legally enforceable electronic contract entered into between you ("User", "Buyer", or "Seller") and BookSell PK ("BookSell PK", "we", "us", or "our") pursuant to the Electronic Transactions Ordinance, 2002 (ETO 2002) and the Prevention of Electronic Crimes Act, 2016 (PECA 2016) of the Islamic Republic of Pakistan.

By visiting www.booksellpk.com, creating an account, signing in with Google, or publishing any book advertisement, you acknowledge that you have read, understood, and agreed to these Terms, as well as our Privacy Policy. If you do not accept these Terms in full, you must discontinue using the platform immediately.

2Nature of the Platform (Intermediary Status)

BookSell PK operates exclusively as an online communications and listing platform designed to assist Pakistani students in discovering and exchanging second-hand academic books.

3User Eligibility & Account Registration

To register an account or publish listings on BookSell PK:

• You must be at least 13 years of age. Users under the age of 18 must use the platform under the supervision or consent of a parent or legal guardian.
• You agree to provide true, accurate, and current contact information (e.g. valid WhatsApp or phone number, primary city, and academic field).
• You are responsible for maintaining the confidentiality of your session and account credentials. All activities carried out under your account are your responsibility.
• Admin accounts are strictly reserved for authorized platform operators. Unauthorized attempts to access administrative functions are strictly prohibited and logged for legal review under PECA 2016 Section 3 (Unauthorized Access to Information System).

BookSell PK maintains high educational integrity. You agree that you will never post, advertise, or promote:

5Peer-to-Peer Safety & Payment Guidelines

Because book purchases occur directly between students:

• Meet in Safe Public Locations: When trading locally in Lahore, Karachi, Rawalpindi, Islamabad, or other cities, arrange exchanges in well-lit public venues such as university campuses, student cafeterias, or established book bazaars (e.g. Urdu Bazaar).
• Inspect Before Paying: Buyers must inspect the physical condition of the book (page completeness, highlighting, syllabus edition) before handing over cash.
• No Platform Escrow: BookSell PK does not hold buyer book funds in escrow. Users agree not to send advance cash to unverified sellers without exercising reasonable caution.

6Ad Listing Fees & Promotion Charges

BookSell PK allows basic student listings and may offer optional paid listing or promotion tiers (Standard, Featured, or Urgent):

• Listing fees paid via JazzCash, EasyPaisa, or Stripe are service fees solely for hosting, marketing, and featured visibility of the advertisement on the platform.
• Listing fees are non-refundable once the ad review process has commenced or the advertisement has been published.
• Payment of an ad fee does not guarantee a successful sale or response from third-party buyers.

7Intellectual Property & Nominative Fair Use

The BookSell PK design, interface code, brand logos, and database structures are the exclusive intellectual property of BookSell PK.

All book titles, author names, publisher imprints (such as Oxford University Press, Caravan Book House, KIPS, STEP, Dogar Brothers, Cambridge University Press, etc.), and cover images referenced on this marketplace belong to their respective copyright holders. Their citation on BookSell PK constitutes nominative fair use strictly for identifying genuine second-hand physical copies offered by individual student sellers.

8Disclaimers of Warranties & Limitation of Liability

To the fullest extent permitted under Pakistani law:

• The platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
• BookSell PK disclaims all liability for the accuracy, condition, legality, safety, or availability of books advertised by third-party sellers.
• Under no circumstances shall BookSell PK or its operators be liable for any indirect, incidental, punitive, or consequential damages resulting from transactions or disputes between users.

9Governing Law & Dispute Resolution

These Terms of Service and any dispute arising from or related to the use of BookSell PK shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan.

Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the competent courts having jurisdiction in Lahore, Pakistan.
